Please note that in these terms and conditions “you”, “your”, “yours” and “yourself” are references to any person accessing, viewing and using this website; including any person who is fundraising for the Thin Blue Line UK, and “we”, “us”, “our” and “ours” are references to the ThinBlueLineUK registered charity (Registration Number 1184042), who are the owner of the website and whose registered office is Thin Blue Line UK, Arena Business Centre, Threefield Lane, Southampton, SO14 3LP. The website domain is https://www.thinbluelineuk.org.uk and all associated and connected pages.


 

Fundraising:


Thin Blue Line UK (Register Charity Number 1184042) is incredibly grateful to those who are willing to give up their time to fundraise to support the charity. However, to protect the reputation of Thin Blue Line UK and safeguard those who support the charity if you wish to fundraise / raise money to support the Thin Blue Line UK you agree to and comply with the following conditions as laid out in this Terms & Conditions.

 

In these terms and conditions references to an activity includes all types of fundraising events and activities, including those shown on the website pages. If you are organising a fundraising or any other type of activity to raise money in support of the Thin Blue Line UK, you agree to;

  1. Comply with the Fundraising Regulator’s Code of Fundraising Practice provisions and Charity Commission Guidelines for events and activities taking place in the UK.
  2. Be responsible for the safe conduct of the activity and take all steps necessary to protect the health and safety of activity participants and spectators, including carrying out all necessary risk assessments, providing all necessary safety equipment and the supervision of participants and spectators;
  3. Obtain and maintain appropriate insurance for the activity, to cover risk of injury or death to participants and spectators;
  4. Be responsible for all costs and expenses relating to the activity;
  5. Comply with all applicable laws and regulations of any country in which the activity is to take place or be publicised, and obtain all necessary licences and consents, in relation to the conduct of the activity; and
  6. Comply with the Charities Institute Ireland Fundraising Codes of Good Practice and the Charities Regulator guidelines for events and activities taking place in the Republic of Ireland.
  7. If requested to do so by the Thin Blue Line UK, you agree to immediately stop fundraising in aid of the Thin Blue Line UK and to then immediately;
  8. Return any funds you have raised in aid of the Thin Blue Line UK to your sponsors or to any persons who have paid to take part in your planned activity (if the activity has not yet happened) and then immediately pay any money (not returned in this way) to the Thin Blue Line UK, and;
  9. Stop using any Thin Blue Line UK Materials you still have and return them to us (or destroy them if asked to do so by us) and delete any electronic copies you have of the our materials.



Events & Media Activities:


In relation to events and/or media activities organised by the Thin Blue Line UK;

  1. You must not participate in the event whilst under the influence of alcohol or drugs nor consume alcohol or drugs during the event;
  2. To secure your place you must pay any required registration fee by the date specified by us unless the event us free;
  3. Participating in certain Thin Blue Line UK events may involve a real risk of serious injury or even death from over exertion, dehydration, accidents with other participants, spectators or road or sea users and other causes;
  4. All participants must act responsibly and take care for their own safety and that of those around them;
  5. Photographs and films may be taken throughout any event organised by us or our affiliated contractors and agents. We rely upon legitimate interest as a lawful basis to use photographs and films featuring event participants for marketing, publicity and fundraising purposes by means of print, broadcast, social media or any other media now or in the future;
  6. We may request consent from a participant to feature in a specific media for marketing, publicity or fundraising purposes. In the event we make such a request it will seek the consent from the Participant in writing (or the Participant's parent or guardian in the event the participant is under 18). You as the Participant may at your sole discretion choose to grant us consent. It is not a condition of our arranged events and activities that such consent is granted;
  7. All Participants and the parents or guardians of any under 18’s acknowledge and agree that no payment will be made to any Participant for the use of any photographs, images or films in which they may feature;
  8. Our use of the Participant's photograph including any personal information contained in any marketing or media activities will be in accordance with our Privacy and Cookies Policy which can be accessed on our website, and stored in line with UK GDPR


The following provisions apply to all activities (including fundraising), whether they are organised by you, the Thin Blue Line UK, or a third party), you;

  1. Agree to ensure that you are eligible to take part in the activity in accordance with any criteria published by the activity organiser (e.g. minimum age, height/weight or health restrictions etc.) and agree to comply with any safety guidelines or other activity rules. We accept no liability for your participation;
  2. Accept that the onus is on you to ascertain whether there are any risks associated with you taking part in the activity and confirm that you are not aware of, or have disclosed when prompted, any medical condition or impairment that may be detrimental to your health if you participate in the activity. If you become aware of any such medical condition or impairment you will withdraw from the activity. If you are in any doubt as to your physical ability to take part in the activity you must consult your doctor before arranging to take part;
  3. Accept that you are taking part in and/or organising the activity independently, on your own initiative and agree to participate in the activity entirely at your own risk, and;
  4. Agree that you will not hold the Thin Blue Line UK, its officers, employees, volunteers or agents liable for any loss, injury, damage or costs that may result from the activity or your participation in it caused in any way other than through the gross negligence of the Thin Blue Line UK. We recommend that you obtain personal accident insurance cover for any activity involving risk of injury;
  5. Agree to be responsible for the collection of any donations that have been promised directly to you;
  6. Agree if a claim is made against the Thin Blue Line UK in relation to the activity (except where the activity has been organised by us) or arising out of any breach by you of these terms and conditions, to reimburse the Thin Blue Line UK for any sums which we pay as a result of that claim including, but not limited to, any associated legal or other costs and expenses;
  7. You agree to compensate Thin Blue Line UK against any claims, damages, legal fees, or expenses arising from your breach of these terms or any act/omission during a fundraising activity not organised by us;
  8. Agree to make clear that you are raising funds in aid of the Thin Blue Line UK and will not indicate or imply that you represent the Thin Blue Line UK or that your activity is run by us;
  9. Agree any entry fees paid are non-refundable. However, if an activity organised by us is cancelled for any reason, the Thin Blue Line UK will, at your request, endeavour to refund any fee paid by you to the Thin Blue Line UK or to offer you a place for an alternative activity. Any refund will be made via the original method of payment and will be processed within 30 days of request by you for a refund. Where an activity organised by a third party is cancelled for any reason, the Thin Blue Line UK is unable to offer a refund or alternative activity;
  10. Agree you must only use any sponsorship forms, posters, banners, leaflets, badges or other Thin Blue Line UK materials provided to you us (whether in hard copy or electronic form) in connection with the specific activities which you have notified us of and in connection with which we have authorised you to raise money in aid of the Thin Blue Line UK. You must not use any Thin Blue Line UK materials in connection with any other activities without first obtaining our written approval;
  11. Thin Blue Line UK reserve the right to approve or deny a fundraiser request before our materials are used;
  12. Acknowledge we provide pre-designed fundraising materials for you to fill in with your activity details and use to promote your activity. You must not use our name, logos or any other assets owned by us (including images) on materials created by you without our prior approval. You may seek our approval in writing via contacting us directly through our website or emailing admin@thinbluelineuk.org.uk ;
  13. Agree to comply with any guidance issued to you by the Thin Blue Line UK or made available on our website;
  14. Agree if you send us any photos or video of your activity that the Thin Blue Line UK may (free of charge) publish or broadcast them to publicise the work of the us (the charity) and to promote fundraising in aid of the Thin Blue Line UK;
  15. Agree that you will not do anything to harm the Thin Blue Lines well respected name and reputation. If you do the Thin Blue Line UK has the right to ask you to stop your fundraising activity immediately.
  16. Agree that for the majority of event types, you are not registered for the event you have applied for and not authorised to fundraise in aid of the Thin Blue Line UK, until we have emailed or written to you to say that your application has been accepted. In some cases, we may first have to request further information before your application can be assessed.
  17. Not to take any costs relating to your activity out of funds raised for us unless;
  • This has been agreed with the Thin Blue Line UK, and;
  • You have made this clear to sponsors and other donors before asking them to sponsor you, provide you with funds including making a donation, completing a transaction such as buying an event, raffle ticket; etc. this list is not exhaustive;



Additional Advice linked to Memorial Balloon Releases:


To order the balloons intended for a memorial balloon release, you must confirm that you have read and accepted these Terms & Conditions, our guidelines, and Code of Conduct. This commitment helps us ensure that the releases are safe and environmentally friendly. Before we send out any memorial balloons, we require proof of age and some personal information from the organisers.

Thin Blue Line UK accepts no liability for injuries, environmental damage, or legal issues arising from a balloon release event not organised directly by us. Please note;

  1. We exclusively use biodegradable balloons and ask that you refrain from adding any weights, launching them one at a time. The balloons we provide are crafted from natural latex rubber and measure less than 12 inches in diameter, decomposing in a time frame comparable to that of an oak leaf;
  2. We offer up to 200 of these balloons free of charge to organisers, along with sharpie-style pens so participants can write messages directly on the balloons;
  3. We request that no ribbons, strings, cards, or additional weights be attached to the balloons; instead, we encourage message writing directly on the balloons. Ninety percent of helium-filled latex balloons without added weight ascend to significant altitudes, where they break into tiny pieces and harmlessly return to the earth;
  4. There has been no study showing that latex balloons harm wildlife. In fact, latex products support the conservation of tropical rainforests and promote reforestation efforts;
  5. Balloons should always be released individually, as single balloons disperse quickly and ascend effortlessly. They should never be tied together in clusters;
  6. We request that you inflate the balloons solely with helium gas, which is lighter than air and aids in the decomposition of the balloon by allowing it to reach greater heights. Helium is an inert gas; it is colourless, odourless, non-toxic, and non-flammable;
  7. Always read and follow the instructions provided on the helium canister, ensuring proper storage, transportation, and handling;
  8. Inhaling helium can lead to asphyxiation, unconsciousness, or death due to oxygen deprivation, so please avoid inhaling it or allowing others to do so;
  9. Make sure to review all Safety Warnings, Legal Obligations, and Disclaimers. There is a legal requirement to display safety warnings on balloon packaging, and responsibility falls to the individual who last opened or repackaged the balloons;
  10. Thin Blue Line UK cannot be held accountable for any accidents or injuries resulting from improper balloon use.


It is essential for you, as the organiser, to understand that;

  1. Children must always be closely supervised around balloons;
  2. Balloons or balloon fragments should never be placed in or near the mouth, as this poses a risk of choking or suffocation with an uninflated balloon or pieces of a popped balloon;
  3. Inhaling helium gas is hazardous and should be strictly avoided, as it can cause dizziness, nausea, vomiting, loss of consciousness, asphyxiation, and even death;
  4. Only individuals over the age of 18 should inflate balloons, and a hand pump or similar device should be used for this purpose;
  5. Damaged balloons should always be disposed of safely;
  6. When handled appropriately, balloons present no threat to health, wildlife, or the environment;
  7. Thin Blue Line UK only supports individual memorial releases of up to 200 individual balloons. The responsibility for ensuring that these releases are conducted safely, and for securing adequate insurance (if necessary), falls to the event organisers and/or the person coordinating the balloon release event, not Thin Blue Line UK.


Organisers must be aware that...

  1. If more than 5,000 balloons are to be released, it is mandatory to apply in writing for permission from the Civil Aviation Authority (CAA) at least 28 days prior to the release;
  2. Additionally, the CAA must be notified of any releases involving up to 5,000 balloons if they occur near an airport or airfield. A form can be obtained by contacting the Airspace Utilisation Section of the CAA at 020 7453 6599;
  3. Organisers should also consider whether Public Liability Insurance may be necessary for their memorial balloon release and make the appropriate inquiries ahead of the event.



Assets and Materials owned by Thin Blue Line UK:


You must not use the Thin Blue Line UK Trade Marks nor any Thin Blue Line UK Images to promote your business (nor that of anyone else) without separate approval from the Thin Blue Line UK. In addition, you must not use the Thin Blue Line UK Trade Marks, assets, materials nor Thin Blue Line UK images on or in relation to any of your products or services or on the packaging, advertising or promotional materials for your business, products or services nor as part of any domain name. As well as physical assets materials owned by Thin Blue Line UK also include digital assets such as (but no exhaustive to) social media templates, logo’s, images and PDF documents.
